Terms of Use

These Terms of Use ("Agreement") govern your use of the Clear Wave - Water Eject application ("the App"), developed by ERCAAP.
By downloading, accessing, or using the App, you agree to these Terms of Use. Please read them carefully before using the App.

1. Acceptance of Terms

By accessing or using the App, you agree to comply with and be bound by these Terms of Use.
If you do not agree with any part of these terms, you must stop using the App immediately.

2. Eligibility

The App is intended for individuals aged 3 and older.
If you are under 3 years of age, you are not permitted to use the App.

3. Purchase and Subscription Options

The App offers different purchase models depending on the platform:

  • iOS Devices:

    • Lifetime Access: A one-time payment provides permanent access to all premium features without any recurring subscription.

  • Android Devices:

    • Annual Subscription: A yearly subscription provides access to all premium features and renews automatically unless canceled.

By purchasing or subscribing, you agree to the following terms:

  • For iOS Lifetime Access: Payment is charged once through your Apple iTunes account at the time of purchase.

  • For Android Annual Subscription: Payment is charged yearly through your Google Play account.

  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

  • You can manage your purchase or subscription and disable auto-renewal through your device's Account Settings after purchase.

  • Any unused portion of a free trial period (if offered) will be forfeited when you purchase a subscription.

4. Payment

All payments are securely processed through your Apple iTunes or Google Play account, depending on your platform.
Prices for subscriptions or lifetime access are subject to change with prior notice before new prices take effect.

5. Content and License

You are granted a limited, non-exclusive, and non-transferable license to access and use the App for personal, non-commercial purposes only.

All content within the App, including but not limited to audio tools, visual designs, and software components, is the intellectual property of Clear Wave - Water Eject and its licensors.

You may not:

  • Reproduce, distribute, or create derivative works from any content within the App without prior written permission.

6. User Responsibilities

You agree to use the App responsibly and in compliance with all applicable laws and regulations.
You must not:

  • Use the App for illegal, harmful, or malicious purposes.

  • Attempt to disrupt or interfere with the App’s functionality or security.

7. Termination of Use

We reserve the right to suspend or terminate your access to the App at any time, without prior notice, if you violate these Terms of Use.
Upon termination, your license to use the App will end immediately.

8. Privacy

Your use of the App is also subject to our Privacy Policy.
By using the App, you consent to the collection, storage, and use of your personal information as described in our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law, Clear Wave - Water Eject and its affiliates will not be liable for any indirect, incidental, special, or consequential damages arising from your use or inability to use the App.

10. Governing Law

These Terms of Use and any disputes arising from your use of the App will be governed by and construed in accordance with the laws of the State of [Insert Jurisdiction], without regard to conflict of law principles.

11. Changes to the Terms

We reserve the right to modify these Terms of Use at any time.
Notifications of changes will be provided via email or through the App.
Your continued use of the App following any updates indicates your acceptance of the revised terms.
